These Terms & Conditions apply to:

• Pre‑orders and pledges made via Kickstarter or other crowdfunding platforms
• Sales of AzNameh products through online shops (Amazon, IngramSpark, etc.)
• Your use of the AzNameh website and related online services

Additional or different terms may apply when purchasing through third‑party platforms.

3. Products and Editions

AzNameh offers physical books, limited editions, and related merchandise, including bookmarks, stationery, maps, art prints, and action figures.

• Standard Editions: Regular trade or fine‑press editions.
• Archive Edition: Kickstarter‑exclusive limited edition.
• Future Limited Editions: Additional numbered or special editions may be introduced later.

4. Ordering Channels

• AzNameh.com: Orders placed directly on our website follow these Terms.
• Kickstarter: Pre‑orders follow both these Terms and Kickstarter’s rules.
• Online Retailers: Retailer terms apply in addition to our conditions.

By placing an order or pledge, you confirm that you are at least 18 years old and legally capable of entering into a binding contract.

5. Prices, Taxes and Payment

Prices are displayed in the currency indicated and include or exclude taxes as specified.

• Taxes: VAT and other taxes apply according to your location.
• Payment Methods: Credit card, PayPal, or platform‑specific systems.
• Payment Timing: Direct orders are charged at checkout; Kickstarter follows platform rules.

We may correct obvious pricing errors before accepting an order. If a pricing error is discovered after your order, we will contact you to confirm whether you wish to proceed at the correct price or cancel.

6. Pre‑Orders and Kickstarter Campaigns

AzNameh may offer pre‑orders for books and limited editions, including the Archive Edition, via Kickstarter or other platforms.

• Nature of Pre‑Orders: Pre‑orders and pledges support production and may be subject to delays.
• Archive Edition: Kickstarter‑exclusive limited edition with conditions defined in the campaign.
• Changes and Delays: Schedules or specifications may be adjusted if necessary; significant changes will be communicated.
• Cancellations and Refunds: Kickstarter refunds follow Kickstarter’s policies; any extra guarantees will be stated in the campaign.

By participating in a pre‑order or crowdfunding campaign, you acknowledge that production timelines are estimates and that delays may occur.

7. Limited Editions and Reservation Rights

Certain AzNameh editions, such as the Archive Edition, are produced in limited quantities. We may offer reservation rights or priority access for specific customers or backers.

• Allocation: Based on pledge/order sequence or campaign rules.
• Non‑Transferability: Reservation rights are personal unless explicitly allowed.
• Availability: Once a limited edition is sold out, we are under no obligation to produce additional copies.

We reserve the right to refuse or cancel orders where we reasonably suspect abuse of reservation systems or unfair practices.

8. Delivery, Risk and Customs

We aim to dispatch products within the estimated timeframes indicated on the website or campaign page. However, these are estimates and not guarantees.

• Delivery Deadline (EU Law): If no date is agreed, delivery must occur within 30 days.
• Risk Transfer: Risk passes upon delivery to your address or carrier collection, depending on local law.
• Customs and Import Duties: International orders may incur duties or taxes, which are your responsibility unless otherwise stated.

If a parcel appears damaged on arrival, we recommend that you note this with the carrier and contact us promptly with photos and details.

9. Returns, Withdrawal and Refunds

For orders placed directly on aznameh.com, you may have a 14‑day withdrawal right under EU law, starting from the day you receive the goods.

• Condition of Items: Returned items should be in their original condition and packaging, unless they were defective or damaged on arrival.
• Exclusions: Certain items (e.g. personalised products or sealed items opened by you) may not be eligible for withdrawal.
• Procedure: Contact us at temple@aznameh.com with your order details to request a return or refund.

For Kickstarter and other crowdfunding platforms, withdrawal and refund rights are primarily governed by the platform’s own policies.

10. Digital Goods and Withdrawal

If AzNameh offers digital content (such as downloadable maps, lore files, or wallpapers):

• You must give explicit consent before download.
• You acknowledge that the withdrawal right is waived once download begins.
• Digital goods are considered delivered immediately upon download.

11. Use of the Website

By using aznameh.com, you agree not to:

• Use the website for unlawful purposes or in violation of applicable laws.
• Attempt to gain unauthorised access to our systems or data.
• Interfere with the proper functioning of the website or services.
• Use automated tools to scrape or copy substantial parts of the website without our permission.

We do not guarantee that the website will be free from errors, interruptions, or viruses. You are responsible for implementing suitable security measures when accessing the site.

12. Intellectual Property

All content related to AzNameh, including text, artwork, maps, designs, logos, and website materials, is protected by intellectual property rights owned or licensed by Maison Artystone.

• You may not reproduce, distribute, or create derivative works from our content without prior written permission.
• Purchasing a book or edition does not grant you any rights to the underlying intellectual property beyond personal use.

Any unauthorised use of our intellectual property may result in legal action.

13. AI‑Assisted Content

Some digital content, images, or materials presented on the AzNameh website or in marketing may be generated or assisted by artificial intelligence tools.

This does not affect the fact that all illustrations inside the final printed AzNameh books are hand‑drawn by human artists. AI tools may be used only to generate improved versions of these hand‑drawn artworks or other materials for the website, social networks, or advertising.

14. Legal Guarantee of Conformity

Under EU law, goods benefit from a 2‑year legal guarantee of conformity.

• Defects appearing within 2 years are presumed to have existed at delivery, unless proven otherwise.
• You may request repair, replacement, or refund depending on the case and applicable law.

15. Retention of Title

Goods remain the property of Maison Artystone until full payment is received.

16. Force Majeure

Under Article 1218 of the French Civil Code, Maison Artystone is not liable for delays or failures caused by events beyond its reasonable control, including natural disasters, strikes, pandemics, war, or supply chain disruptions.

17. Professional Customers

Sales to professional customers (bookstores, distributors) are not subject to consumer protection rules applicable to individuals. Professional orders are final and non‑refundable unless otherwise stated.

AzNameh may be sold or promoted via third‑party platforms such as Kickstarter, Amazon, or IngramSpark, and our website may contain links to external sites.

We are not responsible for the content, terms, or privacy practices of third‑party platforms or websites. Your use of those services is subject to their own terms and policies.

19. Governing Law and Jurisdiction

These Terms & Conditions are governed by the laws of France.

In case of dispute, we encourage you to contact us first at temple@aznameh.com to seek an amicable resolution. Where required by law, you may also have access to a consumer mediation service.

Subject to mandatory consumer rights, any dispute may be brought before the competent courts in France, including the Tribunal de Commerce de Lyon where applicable.
